INDISTINGUISHABLE FROM MAGIC, INC. (‘IFM,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy discloses our practices regarding information we collect and receive from users of the all desktop and mobile websites, mobile applications, and other services provided by IFM (collectively, “Services”). Unless we state otherwise, any new features or functionalities that IFM provides on its websites and/or mobile applications are also part of the Services. By accessing or using the Services, whether through a personal computer, mobile device or any other means, or submitting any content or information for publication or distribution on or through the Services, you agree to be bound by this Privacy Policy. Please read this Privacy Policy carefully before registering or using the Services or submitting any content. If you do not accept this Privacy Policy, you may not use the Services or submit any content.

IFM is growing and changing every day so the Privacy Policy is subject to change by IFM at any time. The most current version of the Privacy Policy can always be viewed through our Services and you will know which is the latest of the Privacy Policy based on the “Effective Date” identified. If you continue to use the Services or submit any content after the latest Effective Date, we assume that you have accepted the new Privacy Policy.

I. Information You Provide or We Collect

IFM receives information you choose to provide to us directly. We also collect information passively or automatically when you use the Services.

a. Information You Provide.

i. In order to register or in connection with other uses of the Services, such as but not limited to identifying an event, or to contact us with an inquiry or to report a problem, you may be asked to provide, or voluntarily provide, certain personally identifiable information, such as your name, e-mail address, street address, telephone number or credit card number (“Personal Information”). You are not required to provide your Personal Information, but if you do not, you may not be able to access or use parts of the Services.

ii. If you submit an e-mail address or other Personal Information through an advertisement on the Service, IFM will share that information with the advertiser so that they may contact you directly. By providing your e-mail address or other Personal Information in or in response to an advertisement on the Services, you may receive promotional emails or other communication from the advertiser. IFM does not control such communication, and information you provide to any third party is not subject to this Privacy Policy.

b. Information We Collect.

i. IFM, its third party service providers, advertisers, advertising networks and platforms, agencies and other partners (“Partners”), may collect or receive information about you or your computer or other device used to access the Services. This information includes, without limitation, your IP address, browser type, operating system, Internet service provider, mobile network, type of mobile device, device identifiers and settings, browser settings, pages you have visited on the Services, location information, and your interaction with advertising and other data when you use the Service.

c. Social Media Services.

We may provide you with the ability to log into the Services with your existing account with a social networking or media service, such as Facebook, Google or Twitter. If you choose to connect to or access the Services with your account with another such social networking or media service, we may share information about you with that service and they may share information with us, including Personal Information. You authorize us to collect, store and use that information for the purposes discussed in this Privacy Policy. Please refer to the privacy policies and Terms of Use for these third party services for information regarding how they use, disclose and otherwise handle your information. We do not control such social networking or media services, your profiles on those services, your privacy settings on those services or rules about how your information on those services will be used. You and the social networking or media service providers are in control of those issues, not IFM. We are not responsible for any acts or omissions by any social networking or media service provider or your use of features that come from their platform.

d. Location Information.

i. If you access or use the Services on a mobile device or through a mobile application, you may be asked to allow us to use Services on your device, such as Wi-Fi, GPS or Bluetooth, to determine your location. You may choose not to provide location information by adjusting the settings on your device or the settings in the applicable mobile application.

ii. In general, the Services deal with location, so in order to work and maximize your uses of the Services, the Services need to know your location. Whenever you open, use and/or interact with our Services, including through our mobile applications on your mobile device or on our websites, we use the location information from your mobile device or browser (e.g., latitude and longitude) to tailor the Services to your current location. This may include showing you a list of nearby events, locations or friends. For example, the Services may use your mobile device’s “background location” to provide the Services, including to provide you with notifications of events or friends near you. If you have “background location” turned on, the IFM mobile application, from time to time, may tell us about your device’s location even if you are not directly interacting with the application.

iii. Each of your events or check-ins, using the Services, will be saved on your account with IFM which will allow you, and your friends, to look back at all of the events and locations you visited or attended since you created your IFM account. You can delete this information from your account. If for some reason you ever decide to delete your Services account, we will try our best but cannot ensure that your entire event, location and check-in history will be removed from our databases.

II. How We Use Your Information

IFM and its Partners may use your information, including Personal Information, to:

a. provide the Services to you, including providing technical and other support for the Service;

b. communicate with you regarding the Services;

c. respond to your inquiries and requests, such as subscriptions to IFM notifications;

d. enforce this Privacy Policy and the IFM Terms of Use and Service, address fraud and other illegal activities, including claims of copyright infringement, and protect your safety and the safety of other users of the Services;

e. for the purpose(s) for which you provide the information;

f. deliver advertising and content that is customized to your individual behavior or demographic, based on your use of the Services, your geographic location, and other online or mobile websites, applications and services;

g. analyze your use of the Services and the performance of and your interactions with advertising and content provided on the Services; and

h. as you may otherwise agree or consent.

If you provide information, including Personal Information, through the Services, in your public profile or by posting or commenting online, such information is available to other users of the Services. IFM does not control use of your Personal Information or any other information by other persons. By posting or publishing your information on the Services, you assume the risk that the information you provide will be viewed and used by third parties including, but not limited, to any other user of the Services.

IFM may also receive information about you that is publicly or commercially available, and we may combine that information with information we have collected or received by other means, including information about your use of the Services, for any of the purposes discussed in this Privacy Policy.

IFM and its Partners may use “cookies” or similar technology to associate your information with an identifier associated with your device or browser. We may also associate cookies with your information, including de-identified or anonymized information, for use by IFM and/or our Partners to share or send information, events, advertisements and offers based on your individual behavior and demographic or geographic location information.

III. How We Disclose Your Information

IFM may disclose your information, including Personal Information, to:

a. Our service providers or Partners who provide services to IFM. These services may include, but are not limited to, those in connection with user support; marketing services; hosting; research and analytics; administration of offers or contests; and/or sending or supporting advertising. The use under this section also extends to any services provided to IFM in connection with the provision of the Services and by those service providers and/or Partners who have agreed to use your Personal Information only as described in this Privacy Policy for, by way of example, authenticating or authorizing your access to IFM. By way of example, IFM may utilize the services of in order to provide you with access to the services of IFM. By agreeing to this Policy, you acknowledge that you have read and reviewed’s governing terms and policies.

b. In order to process a payment, IFM may provide information, including your Personal Information, to a third party payment processor(s). IFM is not responsible for any third party payment processor’s privacy practices.

c. In response to legal process such as a court order or subpoena or a request by law enforcement or a government agency, or as otherwise required by law.

d. In connection with investigation, prevention or action IFM may take, in our discretion, with respect to activities we believe may be illegal, or violate our Terms of Use and Service or other policies, or an emergency that may pose a threat to your or another person’s safety, or as necessary to protect IFM's rights and property.

IFM will not sell your Personal Information to any third party not affiliated with IFM without your consent, except in connection with the sale or merger of IFM or its assets or the division responsible for applicable services, or in the unlikely event of a bankruptcy.

If you register with IFM and create a profile, the information you provide in your profile and the content you submit, such as events, content, posts, photographs, videos, comments, you’re your Content (as defined under our Terms of Use and Service), will be publicly displayed and published on the Services. Your Content that is used or shared with the Services is subject to the IFM Terms of Use and Service.

IV. Cookies, Web Beacons, and Similar Technologies

“Cookies” are pieces of information that may be placed on your computer’s browser or your device by a website or service to store your preferences. These may be used for the purpose of facilitating and enhancing your communication and interaction with a given website or service or with other websites or services. Websites and mobile applications like IFM may also use Flash cookies, or locally shared objects (“LSOs”), that operate similarly to browser cookies. IFM and/or its Partners may also use “web beacons,” clear GIFs or similar technologies, pieces of information placed on a service or e-mail to track and collect information about user behavior, such as by counting the number of visitors to a web page, delivering a cookie to a user’s browser or tracking open rates, clicks and forwards.

IFM, or its Partners, may use cookies and similar technologies to customize your visit to or use of the Services, or to help us to enhance or improve the Services. These include the ability to store your password or deliver relevant advertising, event information or content to you when you use the Services. IFM may also work with its Partners to use such technologies to help provide relevant content, events and/or advertisements to you when you visit other websites or applications, and to research and analyze how the Services are used.

IFM may work with our Partners to synchronize unique, non-personally identifiable identifiers in order to match our identifiers with those used by our Partners. These companies may collect and use non-personally identifiable information during your visits to or use of the Services and other websites and apps. The use of cookies, web beacons and similar technologies by such Partners and advertisers is not in IFM’s control and is subject to the privacy policies of such third parties.

By accessing or using the Services, you consent to IFM and its Partners using the cookies and other technologies described in this Privacy Policy, and similar technologies that may be developed in the future, to track your activities and use of the Services, including in e-mails or other messages or notifications that we may send to you.

Note that you may be able to set your browser to disable cookies or LSOs, or to refuse certain types of cookies or warn you before accepting cookies. While you are able to do so, this may result in certain parts of the Services not working for you. Some Partners may use technologies other than cookies to recognize your computer or device or to collect information about your use of the Services or other websites or services, and you may not be able to block use of such technologies. Some browsers may transmit “do not track” signals to websites and online services. IFM does not currently take any action or respond to such signals.

IFM or its Partners may use mobile Software Development Kits (“SDKs”) to collect information, such as your IDFA or Android Advertising ID, and other information about how your device interacts with the Service. SDKs allow application developers to enable advertising, collection of data and related services and analytics in mobile applications. IFM may use this technology to deliver, or to help Partners deliver, content such as advertising through mobile applications and browsers based on information associated with your device. Depending on your device, you may be able to reset your device’s advertising identifier by accessing the privacy settings.

V. Advertising

IFM and its Partners use cookies, web beacons and similar technologies to provide you with advertising that is relevant to you. Some of our Partners that may use cookies and similar technologies on the Services are listed below. This list is not exhaustive and may be updated from time to time so we ask that you please review the Privacy Policy periodically.

These websites are provided by third parties, not IFM and thus IFM does not control or operate these websites or the choices that they, or any of our Partners may provide through the tools offered on these websites.

VI. Security

IFM places great importance on the security of your Personal Information. We have put in place reasonable physical, electronic, and managerial procedures to safeguard the information we collect. However, IFM cannot and does not guarantee that any communication between you and IFM, or information stored on the Services or our servers or the servers of our Partners, will be free from unauthorized access, or will never be disclosed, modified or destroyed in a way that is not consistent with this Privacy Policy. By accessing or using the Services, you acknowledge and agree that you assume this risk solely.

VII. Protection for Children

IFM Services are not directed at children and IFM does not knowingly collect Personal Information from children under the age of 13. If we become aware that Personal Information has been collected from a child under age 13, we will take steps to delete that information as soon as possible.

VIII. Other Websites

This Policy only addresses the use and disclosure of information by IFM through your interaction with IFM and the Services. Our Services may include and provide links to content, websites and services of third parties, including some of our users. These may include calendars, event listings, merchant websites, news websites and other websites and services, or information from any of the foregoing provided on IFM, not controlled by IFM and which may have privacy policies different than ours. IFM is not responsible for, and does not control, the privacy practices or content of these third parties or third party websites and provides nor warranties, representations or liabilities in connection with the content on, access to or use of those third party websites. These other websites and third parties may have their own privacy policies and terms governing the collection, use, and disclosure of personal information. When you link away from our Services, you do so at your own risk, and should read the privacy policies of such other websites and third parties.

IX. Communications with IFM

By providing your e-mail address, telephone number or other Personal Information to IFM, you expressly consent to receive e-mails, texts or any other communication from us. We may use e-mail or text to communicate with you including to send information that you have requested or to send information about other products or services developed or provided by us. We will not give your e-mail address or telephone number to another party to promote that other party’s products or services directly to you without your consent.

Any communication or material you transmit to us, by e-mail or posting on the Services or other means, including any data, questions, comments, suggestions, or the like is, and will be, treated as, non-confidential and non-proprietary. Except to the extent expressly covered by this Privacy Policy, anything you transmit or post may be used by us for any purpose, including but not limited to, reproduction, disclosure, transmission, publication, broadcasting and posting. You expressly agree that IFM is free to use any ideas, concepts, know-how, or techniques contained in any communication or Content you send to us without compensation and for any purpose whatsoever, including but not limited to, developing, manufacturing and marketing products and services using such information.

X. Updating and Correcting Your Information

If you are a registered user of the Services, you can unsubscribe or opt-out of any service or update your information by editing your user profile. You may also send unsubscribe or opt-out requests to us, at and we will process your request within a reasonable time after receipt. We are not responsible for removing your Personal Information from the lists of any third party, such as a Partner, who has previously been provided with your information in accordance with this Privacy Policy.

XI. International Transfer

The Services are maintained in the United States and are governed by and operated in accordance with the laws of the United States. By accessing or using our Services, you freely and specifically give IFM your consent to export your Personal Information to the United States and to collect, transfer, store, process and use your Personal Information in the United States as specified in this Privacy Policy and in accordance with the laws of the United States, which may differ from those of your country of residence.

Use of the Services, and this Privacy Policy, is subject to our Terms of Use and Services, which is incorporated herein by reference.

XIII. Changes to Privacy Policy

We reserve the right, at our discretion, to change, modify, add, or remove portions from this Privacy Policy at any time. We will post any changes here. Your continued use of the Services following the posting of any changes to this Privacy Policy means you accept such changes.
